Attorney Christopher J McCannGuest Post By Christopher J McCann on How Many Points Is a DUI in California

California Department of Motor Vehicle utilizes what is known as point system to grade driving records. Every driver in CA starts with a clean record. Nonetheless, simple offenses like traffic ticket can affect your driving history.

Incidents that will earn you one point in CA:

Listed below, are some of the incidents that may cause you to earn one point on your driving record:

– Simple traffic violations, for example, driving a car with a broken taillight.

– Simple mechanical issues, for example, malfunctioning head lights.

You can also get a ticket for failing to observe child safety while driving in California. Whereas minor traffic offenses will not earn you a date with judges in Orange County or court in your local area in CA, that could dent your clean driving history.

Traffic incidents that will cause you to earn two points:

Listed below, are traffic offenses in California that will cause you to get 2 points in your driving history:

– Reckless diving.

– Hit and run accidents.

– Operating an automobile with either a suspended or rescinded driver’s license.

– Operating an automobile while under the influence of alcohol either alcohol, prescribed medications or prohibited substances.

How points affect your driving record in California

The more points you get in your driving record, the closer you get to forfeiting your California driver’s license. According to California laws, the department of motor vehicle has the authority to issue a notice of suspension of your driver’s license after accumulating a particular amount of points on your driving record over certain duration of time. If you fail to request a DMV hearing, then your California driver’s license will automatically be suspended.

Your California driver’s license can be suspended or revoked if:

– You have earned 4 points over a period of 1 year.

– You have earned 6 points over a period of 2 years.

– If you have earned 36 points over a period of 3 years.

In contrast to what a majority of people think, driving histories are not cleared if the points earned are more than 12 months old.
